Governor Culver Takes Action On Legislation

DES MOINES – Today, Governor Chet Culver signed the following legislation:

House File 2137:
HF 2137 makes changes to the membership of the Board of Education Examiners.

  • HF 2137 removes a restriction in the definition of practitioner which excludes an individual from holding or receiving a license from a professional licensing board other than the Board of Educational Examiners, and adds that the term "practitioner" may include a licensed individual who holds a statement of professional recognition.
  • The bill establishes that the Director of the Department of Education or the director's designee, as a member of the Board, like the public members, is exempt from the requirement that members hold a valid practitioner's license during the member's term of office.
  • The bill eliminates language which permitted a professional development program provided by a school district and approved by the State Board of Education before July 1, 1989, to continue until the term, for which the program was approved, expires.

House File 2151:
House File 2251 repeals the sunset date included in the law for the Advanced Practice Registered Nurse Compact adopted in the 2005 Session. The Compact was established to allow Advance Practice Registered Nurse to be licensed in other states and allow Advanced Practice Registered Nurses to be able to practice in the states in the compact.

  • Sec. 1 changes wording slightly to state that advance practice registered nurse are considered to be licensed in the state.
  • Sec. 2 through 4 repeals the previous July 1, 2008 sunset.
  • Sec. 5 makes the bill effective upon enactment.

House File 2167:
House File 2167 updates the list of controlled drugs by adding several new drugs or derivations of previous drugs to the controlled drug list. These changes conform with the scheduling actions of the federal Drug Enforcement Agency.

  • Sec. 1 adds orpavine to the list of Schedule II controlled drugs.
  • Sec. 2 adds lisdexamfetamine, its salts, isomers and salts of its isomers to the list of Schedule II controlled drugs.
  • Sec. 3 adds embutramide to the list of depressants classified as Schedule III controlled substances.
  • Sec. 4 adds dronabinol (derived from the cannabis plant) to Schedule III controlled substances.
  • Sec. 5 strikes references to pseudoephedrine and phenylpropanolamine as precursor substances required to reported. These drugs are regulated as Schedule V controlled drugs.

Senate File 2101:
SF 2101 transfers administration of the Entrepreneurs with Disabilities program to the Department of Education.

  • SF 2101 transfers administration of the Entrepreneurs with Disabilities program from the Iowa Finance Authority to the Division of Vocational Rehabilitation Services of the Department of Education.
  • The purpose of the Entrepreneurs with Disabilities program is to provide technical assistance, business development grants, and financial assistance grants to qualified Iowans with disabilities.
